Having debts is probably one of the worst feelings in the world. Every time you have cash on hand, you cannot spend it without thinking how much debt you still need to pay off. UK debt recovery law states that if an account is overdue by sixty days then debt recovery can be considered. The creditor should frequently have contact with the debtor, reminding him or her about his or her debt. If after sixty days the debtor still refuses to pay his or her account, then either party can initiate a mutual debt recovery solution.
The creditor should be fully aware of their debtor's financial capabilities. The success of the debt recovery depends on how much information the creditor has on its debtor; this is where the original application form becomes useful as if comprehensive it will contain a lot of the information needed.
There are various steps the debtor can take to recover his debts, including liaising with the debtor, engaging with a solicitor to write a letter explaining what is owed and what will happen if this is not paid, engaging with third party debt collectors to repossess items and collect payments, and ultiamtely taking the debtor to court.
If you are in debt, you want successful debt recovery and it is best to confront matters before they get completely out of control. You may want to try and do this yourself and for example negotiate a revised payment schedule, alternatively there are debt management solutions companies who can offer expert debt advice. The sooner you take action the sooner you will get out of debt.
